The full explanation: how gambling law works in Canada
Canada has no national online casino licence. The Criminal Code sets the rules and hands gambling to the provinces.
Section 207: the provinces run gambling
Part VII of the Code bans most betting, then carves out exceptions. The key one is section 207(1)(a):
“… for the government of a province, either alone or in conjunction with the government of another province, to conduct and manage a lottery scheme in that province”
Section 207(4)(c) adds that games played on a computer or video device can only be run under that provincial branch. That is why each province has its own gambling site, and why Ontario and Alberta could open private markets under provincial control.
What that means for players
The gaming offences target people who keep, run or promote a game: a common gaming house (s. 201(1)), bookmaking (s. 202), lotteries (s. 206). The one player-side offence, being “found in” a common gaming house (s. 201(2)), is written around a place. I could not find a reported case of a Canadian charged simply for playing at an online casino licensed elsewhere.
